• To register you as a new client and manage our relationship.
• To process and deliver your projects, including invoicing, collection of payments.
• To manage our business and improve customer service.

• To deliver relevant website content and measure the effectiveness of our communications.
• To comply with legal obligations, such as tax and accounting requirements.

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason compatible with the original purpose.

3. Disclosure of your information

We may share your personal data with the following categories of third parties:

• Service providers: IT hosting, payment processors (Stripe, PayPal), cloud storage, email delivery, project management tools.

We do not sell, rent, or trade your personal information to third parties for marketing purposes.

4. International transfers

Some of our external third-party providers are based outside Jamaica (e.g., USA, EU). Their processing of your personal data will involve a transfer of data outside Jamaica. We ensure adequate protection by using Standard Contractual Clauses or relying on Privacy Shield frameworks where applicable.

5. Data security

We have implemented appropriate security measures (encryption, firewalls, access controls) to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way. We also have procedures to deal with any suspected personal data breach and will notify you and any applicable regulator when legally required.

6. Data retention

We will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for legal, accounting, or reporting requirements. By law we must keep basic client records (contact, financial, transaction data) for seven years after they cease being clients for tax purposes.

7. Your legal rights

Under certain circumstances, you have rights under data protection laws in relation to your personal data:

• Request erasure of your personal data (subject to legal holds).
• Object to processing of your personal data.
• Request restriction of processing.

Terms of service

These Terms govern the use of Appecable Tech's website, consulting, and development services. By accessing or using our services, you agree to be bound by these Terms.

1. Definitions & interpretation

"Client", "you" means the individual or entity using our services. "Agreement" includes these Terms and any project-specific Statement of Work. "Deliverables" means the work product specified in an SOW.

2. Account and registration

• You must be at least 18 years old and provide accurate, complete information.
• You are responsible for safeguarding your account credentials and for all activities under your account.
• We reserve the right to suspend accounts for suspicious activity or violation of Terms.

3. Services and project engagement

• We offer web development, software consulting, UI/UX design, and digital strategy.
• Each project will be governed by a separate Statement of Work (SOW) referencing these Terms.
• Timelines are estimates; we will notify you promptly of any delays.
• We may use subcontractors, but we remain responsible for their work.

4. Fees, payment & taxes

• All fees are in Jamaican Dollars (JMD) unless agreed otherwise.
• Invoices are due net 15 days from invoice date. Overdue balances accrue interest at 2% monthly (24% APR).
• Initial consultation (up to 1 hour) is complementary; subsequent consulting is billed at $6,000 JMD per hour.
• You are responsible for all applicable taxes, duties, or levies.

5. Intellectual property rights

• Pre-existing IP: Each party retains ownership of IP developed prior to the project.
• Deliverables: Upon full payment, we assign all rights (including copyright) of the specific deliverables to you.
• License to use: We grant a non-exclusive license to use any pre-existing IP incorporated into deliverables.
• Portfolio: We may display your project in our portfolio unless you opt out in writing.

6. Client obligations

• Provide timely feedback, content, and access to necessary systems.
• Ensure you have all rights to materials you provide (logos, text, images).
• Cooperate in good faith to enable project completion.

7. Confidentiality

Both parties agree to keep confidential all non-public information (including trade secrets, project details) disclosed during the engagement. This obligation survives termination.

8. Warranties and disclaimer

We warrant services will be performed in a professional manner. However, we do not warrant that the website or deliverables will be error-free or uninterrupted. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL IMPLIED WARRANTIES (MERCHANTABILITY, FITNESS) ARE DISCLAIMED.

9. Limitation of liability

NEITHER PARTY SHALL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES (LOST PROFITS, DATA LOSS). OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRIOR TO THE CLAIM.

10. Termination

• Either party may terminate a project SOW with 30 days' written notice.
• Upon termination, you pay for all work completed and expenses incurred up to the termination date.
• We may terminate immediately if you breach these Terms and fail to cure within 7 days.

11. Dispute resolution & governing law

Any dispute shall first be submitted to mediation in Hanover, Jamaica. If unresolved, binding arbitration under the Arbitration Act of Jamaica will apply. These Terms are governed by Jamaican law.
